Various instruments of the United Nations have commented on forced treatment, or involuntary confinement, or both (for details, see Burstow, 2015a), and a number of truly critical additions to international law have materialized. Arguably, the most significant of these is the Convention on the Rights of Persons with Disabilities. What makes it so significant? For one thing, it is because this landmark convention puts forward nothing less than a total ban on both involuntary treatment and the involuntary confinement of people who have broken no laws.

I’m not going to attempt to take that away from her, but whereas so many issues encompass shades of gray, the chemical imbalance theory does not. The chemical imbalance theory is not just unproven; It is debunked. But you need not take my word for it.

I’ve been arguing against calling this movement that I’m a part of a ‘peer’ movement for a long time. What has happened with Michael Brown in Ferguson, Missouri has helped me to crystallize that point. Again and again I am told the ‘severely mentally ill’ are impaired and incapable, not quite human. I am told the “high utilizers” and “frequent flyers” burden services because they are different than the rest of us. And when I finally do meet the people carrying that terrible, stigmatizing label of schizophrenia, what do I find? I find – a human being. A human who responds to the same listening and curiosity that I, or anyone, responds to. I find a human who is above all terrified, absolutely terrified, by some horrible trauma we may not see or understand.

In an Op-ed for the Times Union, Madeleine Ringwald explains how the Helping Families in Mental Health Crisis Act “would severely disable protection and advocacy organizations from protecting the civil, legal and human rights of people in mental health services.” “Whether you examine it through a scientific, civil rights or bottom-line lens, Murphy's bill should appall you,” she writes. “Any legislation that bolsters institutionalization at the cost of community-based services seeks not to help those with mental health needs, but help society find ways to hide, suppress and silence them.”

Today, July 1, 2016, the Alaska Supreme Court issued its Opinion in In the Matter of the Hospitalization of Mark V.    What strikes me the most about the case is that Mark's expressing the view that a psychiatric drug he was being required to take is poison, that it had side effects related to his sexual performance, and that it was killing him were all cited as proving Mark was delusional. As readers of this site know, these drugs can quite reasonably be characterized as poison, they do cause sexual dysfunction, and they are quite lethal to many many people, shortening lives on average by 25 years for those in the public mental health system, such as Mark.

In an article published by the Treatment Advocacy Center, The Shortage of Public Hospital Beds for Mentally Ill Persons, the authors (D. J. Jaffe and E. Fuller Torrey) present the idea that we have far too few hospital beds in this country, and because of that there has been a dramatic shift towards the diversion of people labeled with mental illness into prisons and homelessness. Their answer to this issue is that we should radically increase the amount of hospital beds and we should also dramatically increase our reliance on outpatient treatment in the form of mandated involuntary medication programs. As many people know here, the TAC has been highly influential politically and the authors of this paper have been instrumental in getting laws passed that mandate the outpatient use of psychiatric drugs for people who have been civilly committed.
